Report shows Marino was in danger of losing his job - newsitem.com Posted: 24 Sep 2010 01:25 AM PDT A crisis of confidence in Tom Marino's leadership put his career as a U.S. attorney in jeopardy a year before he abruptly announced his resignation in September 2007, according to a Justice Department report. A senior Justice Department official recommended firing Marino in September 2006, saying he "perceived that Marino was not leading his office," according to the report, which has taken on fresh relevance as the Republican challenges Democratic incumbent Chris Carney in the 10th Congressional District. D. Kyle Sampson, the chief of staff to then-Attorney General Alberto Gonzales, subsequently placed Marino's name on a list of U.S. attorneys he said the department, "should consider pushing out," based on "problems" he learned about in summer 2006, according to the report, which was examined this week by The Citizens' Voice, a sister newspaper of The News-Item. Sampson, now a partner with the Washington, D.C., law firm Hunton & Williams, said Wednesday he did not have "any recollection" of what "problems" may have led to Marino's inclusion on the list. Sampson, in a brief telephone interview, cast doubt on the veracity of much of the 300-plus page report, but confirmed the discussions about Marino's future and possible dismissal. Sampson said he could not recall whether those discussions centered on Marino's friendship with Dunmore businessman Louis DeNaples, a convicted felon who used a December 2005 endorsement from Marino to help secure a state gaming license for his Mount Airy Casino in Monroe County. Marino, who has since claimed he was authorized by his superiors to help DeNaples, announced his resignation a month after the Allentown Morning Call broke the news that he had served as a personal reference on DeNaples' licensing application. "It's ancient history," Sampson said Wednesday. "Obviously he wasn't removed (in 2006) and I wish him all the best." Marino and two other targeted prosecutors survived the purge, which led to the replacement of 11 U.S. attorneys and triggered investigations in Congress and within the Justice Department into allegations the firings were politically motivated. The report, published in September 2008 after the conclusion of the Justice Department investigation, said Sampson spared Marino and one other U.S. attorney, Paula Silsby, of Maine, solely because of their political connections and the potential backlash from their allies in the Senate. The report said Sampson "did not ask for Marino's resignation" because he did not want to risk a "brush fire" with Sen. Arlen Specter, the former chairman of the Senate Judiciary Committee who recommended Marino for the U.S. attorney position in 2002. Specter, a longtime Republican-turned-Democrat who will leave office in January after a primary election loss to U.S. Rep. Joe Sestak, was unavailable for comment Wednesday, according to a spokesman. A spokesman for Marino's Congressional campaign, Jason Fitzgerald, dismissed the revelations in the Justice Department report as another distraction in a race that has centered more on missteps and personal defects than social issues and policy positions. "We're really not going to play in the mud on this stuff," Fitzgerald said Wednesday. "Those claims are totally without merit. Tom Marino was a distinguished prosecutor." Questions about Marino's standing as a U.S. attorney began bubbling as early as January 2006, as senior officials in the White House and the Justice Department assembled lists of "problem" prosecutors, according to the report. Monica Goodling, the Justice Department's former deputy director for public affairs, initially characterized Marino as "quiet" and told Sampson he was someone she was "not sure about," according to the report. Nine months later, Sampson appeared with a more resolute verdict: he wanted Marino gone. The timing of Goodling's concerns about Marino, in January 2006, and Sampson's call for his dismissal, in September 2006, appeared to coincide with two significant events in Marino's path to the exit: his December 2005 endorsement of DeNaples' casino aspirations and his decision, made privately in September 2006, to eventually quit. Marino announced his resignation on Sept. 21, 2007, telling reporters he had been waiting a year for the right opportunity to break away and that his departure had nothing to do with a federal investigation of DeNaples or their friendship. Despite Marino's claims, his friendship with DeNaples and his involvement as a reference on the Mount Airy Casino license application had long complicated his ability to lead the U.S. Attorney's Office for the Middle District of Pennsylvania in the months before his resignation. The federal investigation eventually ceded to a state probe and the only charges filed against DeNaples - perjury during testimony to a Dauphin County grand jury - were withdrawn in April 2009 as part of a deal that allowed him to turn over control of the casino to his daughter, Lisa. Marino's office had been investigating DeNaples, convicted in 1978 for cheating the federal government of more than $500,000, when Marino provided the personal reference. Marino waited a year to disclose his relationship with DeNaples to the Justice Department, forcing them to reassign the probe to an office in Binghamton, N.Y. in January 2007, according to newspaper reports published after his resignation. If Sampson had his way, Marino would have been gone by then. According to the report, Sampson deleted the Maine prosecutor Silsby and Marino from the target list, "but not because anyone disagreed with the removal recommendation." "Silsby's and Marino's names were removed because both were believed to have the political support of their home-state senators," the report said, alluding to Susan Collins and Olympia J. Snowe in Maine and Specter in Pennsylvania. "The judgment was made not to risk a fight with the senators over the proposed removals." Marino remained in office for three weeks after his September 2007 resignation announcement. Three months later, in January 2008, he returned to DeNaples' fold, accepting a $249,999-per-year position as full-time counsel to DeNaples non-casino interests. Marino remained with DeNaples until last December, when he left to run for Congress. Following Milovan Rajevac's decision to step down earlier this month, the Ghana FA has now received over 60 applications from European coaches and Pappoe said on Ghanasoccernet: "I have cited his (Zola's) application." Ghana-born former France international Marcel Desailly is still believed to be a serious contender for the position and has rejected widespread rumours that he is making excessive financial demands. A statement on his behalf read: "Marcel has not been on any platform or in any meeting anywhere asked for a salary of 120,000 dollars as is being speculated in the mass media." Uganda boss Bobby Williamson has also been linked with the position and, while it is believed he has not submitted an application, he has suggested he would consider the post. "It's very flattering to be linked with the Ghana position as they are one of the top nations on this continent and have the potential to be a world force," he told KickOffGhana.com. "As it is, I also believe Uganda can be a real force and my allegiance is them at the moment."
